Welcome to FamPass. These Terms of Service ("Terms") govern your use of the FamPass mobile application (the "App") operated by Appystrano, LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Service Description
FamPass is a family event discovery application that helps parents and caregivers find family-friendly events and activities in select metropolitan areas across the United States.
The App aggregates event information from various third-party sources and presents it in a curated, searchable format. Users can browse events, save favorites, and receive personalized recommendations based on their selected metro area.
2. Account Registration
To use certain features of the App, you must sign in using Sign in with Apple. By creating an account, you agree to:
- Provide accurate information as requested during the sign-in process.
- Maintain the security of your Apple ID credentials.
- Accept responsibility for all activity that occurs under your account.
- Notify us promptly of any unauthorized use of your account.
3. Subscriptions and Payments
3.1 Subscription Plans
FamPass offers the following subscription plans:
- Monthly Plan: $8.00 per month
- Annual Plan: $48.00 per year (equivalent to $4.00 per month)
3.2 Billing and Auto-Renewal
Subscriptions are billed through your Apple ID account via the App Store. All subscriptions automatically renew at the end of the current billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
3.3 Free Trial
If a free trial is offered, the trial period will be specified at the time of signup. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
3.4 Cancellation
You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. For refund requests, please contact Apple Support directly.
3.5 Price Changes
We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period following notice of the change. Your continued use of the App after a price change constitutes your acceptance of the new pricing.
4. Event Information Disclaimer
Event listings displayed in the App are sourced from third-party websites and public sources. While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any event information, including but not limited to:
- Event dates, times, and locations
- Ticket prices and availability
- Event descriptions and age recommendations
- Venue accessibility and amenities
- Cancellations or schedule changes
You are solely responsible for verifying event details directly with the event organizer or venue before attending. FamPass is not liable for any loss, inconvenience, or expense arising from reliance on event information displayed in the App.
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- In no event shall FamPass, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you paid to us in subscription fees during the twelve (12) months preceding the claim.
6. User Conduct
You agree that you will not:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any portion of the App, other accounts, or any systems or networks connected to the App.
- Interfere with or disrupt the operation of the App or the servers or networks used to make the App available.
- Use any automated means, including bots, scrapers, or spiders, to access or collect data from the App.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
7. Intellectual Property
All content, features, and functionality of the App, including but not limited to the design, layout, graphics, text, images, software, and code, are the exclusive property of Appystrano, LLC or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. Termination
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Los Angeles County, California.
10. Changes to These Terms
We may modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appystrano, LLC regarding your use of the App.
